Общее название программ, которые осуществляются в штатах и предусматривают возмещение ущерба работнику или членам его семьи в случае получения им производственной травмы, профессионального заболевания или его смерти в результате несчастного случая на производстве. В законах предусматривается ответственность работодателя за нарушение техники безопасности, а также выплата пособий, включая оплату лечения и компенсацию за потерю трудоспособности. Такие пособия оплачиваются из страховки, которую работодатель приобретает для каждого работника. В XIX в. опасность определенной работы была частью риска, на который работник соглашался при найме; в соответствии с существовавшим правилом ["fellow servant" rule] он не мог предъявить иск к работодателю, если причиной получения травмы была его собственная небрежность. В 1908 Конгресс отменил это правило для железнодорожников, приняв Национальный закон об ответственности работодателей [National Employers' Liability Act]. В 1911 в штате Висконсин была принята первая программа социального страхования [ social security], которая предусматривала выплату обязательного пособия по нетрудоспособности; с 1949 такие законы есть во всех штатах. Федеральное законодательство предусматривает программы выплаты пособий федеральным служащим, а также другим категориям работников, выплата пособий которым не предусмотрена законами штатов (в начале 1990-х к этим категориям относилось около 15 процентов работников, в том числе моряки торгового флота и работники частных компаний в округе Колумбия [ District of Columbia]). Основные законодательные акты в этой области: Закон о компенсации федеральным служащим [Federal Employees Compensation Act] (1916), Закон о компенсации портовым грузчикам и другим портовым работникам [Longshore and Harbor Workers' Compensation Act], а также Закон о пособиях при болезнях легких [Black Lung Benefits Act], предусматривающий выплаты шахтерам.
